Cosmetic dermatology: legal issues.

Abstract

Laser and light-based procedures, fillers, toxins and various peels have revolutionized the field of cosmetic dermatology. With an increasing number of physicians and nonphysicians performing these procedures, and with the availability of a seemingly unlimited array of cosmetic dermatology procedures, the potential for problems and their legal consequences continue to increase. This article will discuss the concept of negligence and the potential for medical malpractice, including the associated problems that may arise when these procedures are performed by physician extenders. The impact of the physician and physician extender relationship, and the legal issues that arise, are also discussed. The article concludes with the legal and ethical issues associated with the promotion of cosmeceutical agents in the field of cosmetic dermatology.
