Drugs and testamentary capacity.

Abstract

Drugs, or withdrawal from them, can cause changes in consciousness, reasoning ability, perception of reality, and memory, all of which could affect testamentary capacity. When asked whether a person is, or was, capable of making a will, one should take into account the possible effects of drugs or drug withdrawal on the person's ability to comprehend the nature of a will, the assets to be disposed of, and the potential beneficiaries.
